Speaking to news agency ANI, Bidkar said Pandya appeared to be unaware of the seriousness of the act during the celebrations. He stated that national symbols must always be treated with dignity, even during moments of excitement and victory.
According to the advocate, the alleged act could fall under the Prevention of Insults to National Honour Act, 1971. Section 2 of the act states that any person who burns, mutilates, defaces, or otherwise brings the Indian national flag into contempt in a public place can face legal consequences.
If a case is registered and proven, the punishment under the law can include imprisonment for up to three years, a fine, or both. However, it is important to note that at this stage, the police have only received the complaint application.
Authorities at the Shivaji Nagar Police Station have not yet confirmed whether a First Information Report (FIR) will be officially registered. Officials are expected to review the complaint and the available video evidence before deciding the next course of action.
